I.  Overview

Elizabethtown Gas Company and its affiliates (collectively, “Elizabethtown Gas Company,” “ETG,” “we,” “us” or “our”) are committed to maintaining your privacy. Our goal is to ensure your confidence when handling the personal information that you provide to us. This notice (this “Privacy Policy”) describes what information we may collect about you when accessing our website, how we collect it, how we use it, with whom we may share it and the choices you may make regarding how your information is shared. This Privacy Policy is incorporated into and is a part of the Terms of Use of the Elizabethtown Gas Company Web site (elizabethtowngas.com) and/or any of its affiliate sites or any subsequently developed sites or replacement sites, the “Site”). We encourage you to become familiar with the terms and conditions of both this Privacy Policy and the Terms of Use. By accessing and using the Site, you agree that you have read and understand this Privacy Policy and you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Privacy Policy. This Privacy Policy applies to anyone who visits our websites, social media sites or pages, or uses our mobile applications.

II. What Information Do We Collect?

In an effort to protect both your personal information (“PI”) and personally identifiable information (“PII”), we minimize the use, collection and retention of PII to what is strictly necessary to accomplish our business purposes. While we do not require you to provide PI in order to navigate our Site, we must collect certain PI and PII if you choose to use our services (i.e., enrollment and use of My Account, entering a contest, completing a survey, etc.). We will collect and retain certain PII to assist you with your account, provide you with customer service support, register your employment application, or provide you with marketing materials regarding our services and promotions. We may also retain any correspondence and/or testimonials that you may have provided to our representatives, whether written or verbal. This may include any of your questions, comments, or suggestions submitted through our Site or if you fill out a survey.

  1. Personal Information: PI is information that identifies you as an individual or relates to you as an identifiable individual. PI may include, but is not limited to, your first and last name, home or business address, email address, and telephone number.
  2. Personally Identifiable Information: PII includes information where your name is combined with information such as your maiden name, social security number, passport number, driver’s license number, taxpayer identification number, address, telephone number, email address, account number, credit card information, bank account information, employment history, educational background, compensation information, etc. or unique biometric data.
  3. De-Identified Information. In addition to retaining PII, we also collect non-identifying information regarding how the Site is used, how many users have visited the site, what features of the Site are most popular to users and what information users searched for on the Sites. We also gather information about the browser itself, like what browser and version you are using, the operating system you have, which site you used to link to our Site, how much time you spent on the Site, etc. We may also use cookies (which are small text files that a website’s server places on your computer and helps us recognize you when you visit our Site) and/or other online tracking devices such as pixel tags and clear GIFs (which is a small string of software code that represents a graphic image on a website or email) to collect online data from you depending on your browser settings. We collect this information in order to help us make our Sites more useful to our visitors, as well as to generate aggregate, non-identifiable statistical information so that we can improve our content and services. We also retain your online data which may include your IP address, your browser type and language, data about your mobile device, advertising identifiers, geolocation data, social media preferences and any other online aggregated data not related to PII (also known as “De-Identified Information”). When you visit our Site, we collect the IP address of the device you use to connect to the Internet.​
  4. Marketing and Surveys. When you visit the Site we may ask if you would like us to send you marketing or customer service materials about our services and other associated products and services. As part of our efforts to provide you with better products and services and to increase customer satisfaction, we may share information with third-party providers that assist us in providing those products and/or services to you. From time to time, we may include survey forms on the Site. For example, we may survey customers concerning issues that are important to us, such as customer opinions or services offered. We may disclose aggregated survey results to other third parties, such as the public service commission, rating agencies, or advertising agencies. We may also use your qualitative survey feedback with your first name in our marketing materials.  Additionally, we do provide our survey vendors with limited personal information needed to conduct the survey, such as customer account numbers and addresses.

PI, PII and De-Identified Information (“Collected Information”) enable us to improve our Site, our services and the experience that we ultimately provide you. Unless otherwise described in this Privacy Policy or our Terms of Use, such identifying information will be used solely for our internal business purposes.

III. Third Party Sites and Services

  1. This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which the Site links. The inclusion of a link on the Site does not imply endorsement of the linked site or service by us or by our affiliates.
  2. Billing and Payment Services: PLEASE NOTE that Elizabethtown Gas Company does not collect any credit card or banking information via its Sites. When you access the Elizabethtown Gas Company website to view your account information, you will be directed to the website of our My Account site which is hosted by Meridian. Payment collected on the site is processed by our payment collection provider, known as Bill2Pay “Bill2Pay”. Bill2Pay is not a Elizabethtown Gas Company affiliate and
    1. PLEASE NOTE that when you click the link that says, “Manage Your Account” to pay your billing statement or access certain account information, you will be directed to the KeepTrac My Account website.
    2. PLEASE NOTE that when you send us payment via check or money order for your gas bill via the billing mailer addressed to: Elizabethtown Gas Company, P.O. Box 5412, Carol Stream, IL 60197-5412, those checks are gathered securely and then shredded after the payments are applied. ​
  3. Linked Sites: We may allow certain hyperlinks to be posted on our Site for your convenience in accessing information. Please be advised that the websites of other companies are not under our control and we do not control the content on the websites of other companies. We are not responsible for and this Privacy Policy does not apply to, the privacy practices of the websites of other companies that we do not own or control. We encourage you to seek out and read the privacy policy of each Web site that you visit. You should also know that any information you provide on, or to the linked site of another company is governed by that site’s privacy policy. For your protection, you are encouraged to read and understand a website’s privacy policy as to how your personal information will be used before using that website. In some cases, our Site links to other websites that collect PI and PII by and for other parties. In these cases, the PI and PII you provide on those websites is governed by the privacy policy of that website. We do not assume responsibility for the actions of other parties.
  4. Email: Discretion should be exercised in what information you send to us by email. We cannot guarantee that email sent over the Internet is secure and will not be intercepted by others before it reaches us. We are not responsible for the security of information contained in emails sent over the Internet.

IV. How Do We Protect the Information Collected About You?

Elizabethtown Gas Company takes commercially reasonable measures to secure and protect information transmitted via or stored on the Site and transmitted to and from the Site. Nevertheless, no security system is impenetrable. We cannot and do not guarantee that information submitted by users of the Site, or any communications conducted on or through the Site will be totally secure. You agree to immediately notify us of any breach of Site security, this Privacy Policy or the Terms of Use of which you become aware by contacting us at customercare@sjindustries.com.

V. How Do We Use the Information We Collect?

In addition to the uses mentioned or described above, or otherwise described in our Terms of Use, we use the Collected Information to accomplish the purpose for which it was submitted. For example, if you submit your credit card information to make a payment on your account, we will use that information to make that payment. We may also use the Collected Information to notify you of changes made to the Site; to send you promotional materials that you request from us; to verify whether your system meets the minimum requirements necessary to use our Site’s various services; to advise you of promotions; and for other legitimate and lawful business purposes. Below are some examples of how your information may be used:

Customer Accounts: We will use your PII to: (1) verify your identity; (2) access your accounts; (3) service and manage your accounts; (4) enable you to use online tools or perform certain online transactions; (5) respond to your inquiries regarding your account; (6) conduct online transactions; (7) comply with federal, state and local laws, civil, criminal or regulatory investigations, or other legal requirements; and (8) assist us in taking data security and fraud prevention precautions.
  2. Communication: We use PI to communicate with you about our Site. We may also use your PI to send you account updates or other communications regarding your account or to inform you of any changes to our Site or the services we provide, or to send you information, recommendations and promotions that we believe will be of interest to you. ETG may send the contact information collected through our Site to other ETG affiliates, to the extent permitted by applicable law, or such communications may be sent directly to you through our Site.
    1. You should note that ETG may use other electronic media for communications (such as social media), which may have its own separate privacy policies that govern the privacy of information that is shared or collected through your use of them.
  3. To Improve Our Services: We may use your PI for statistical analyses, generating surveys, and doing market research in order to improve our services. We may use information collected on our Site to personalize your experience on our Site.
  4. Site Maintenance: We analyze how our users interact with our Site in order to maintain and improve our Site. We also use information that we collect to diagnose any problems with our Site.
  5. Social Media: In order to provide customers and potential customers with more options for contacting Elizabethtown Gas Company, we have official pages on the social media websites Facebook®, Twitter®, LinkedIn® and YouTube®.  When you interact with us on our social media websites, we collect analytics regarding your likes, interests and feedback regarding Elizabethtown Gas Company and its products and services. This information is used for internal purposes only. When you interact with Facebook®, Twitter®, LinkedIn® and YouTube®, you are subject to their terms of use and privacy policies. We may collect certain information about you that you have posted and made public on social media websites. We strongly advise that you avoid posting/sharing confidential, financial or other sensitive information like your Social Security number, bank account number, phone number, mailing address or email address when posting to a social media site. Any posts that you make on our official social media pages (including posts that contain pictures, comments, suggestions, opinions, complaints or personal information) are publicly available to others who use those pages, as well as the companies operating the websites on which they appear.   6. Legitimate Business Purposes: We may use your PI or PII for any other business purpose we deem legitimate, as permitted by applicable law.

VI. With Whom Do We Share Collected Information?

In the course of conducting our business, we may, as appropriate, share Collected Information with ETG companies and affiliates, as well as with trusted third parties who are contractually obligated to keep such information confidential and only use such information to provide the services we have asked them to perform. We may also provide Collected Information to certain interest-based advertisers. These providers may collect information from you using the cookies on your browser use cookies your Collected Information and/or demographic or interest-based data, in order to target you with advertising related to our products or services. We reserve the right to share information, including PII, with third parties, as described below:

  1. Service Providers: We may share information with service providers that help us perform Site functions and process your transactions. For example, we share information with electronic bill payment service providers so that you may pay for services through our Site.
  2. Affiliates: We may share information with a parent company, franchisees, subsidiaries, joint ventures, or other companies under common control with us, to the extent permitted by applicable law.
  3. Corporate Structure: We may share information in connection with a merger, acquisition, consolidation, change of control, or sale of all or a portion of our assets or if we undergo bankruptcy or liquidation.
  4. To Prevent Harm: We may share information if we believe it is necessary in order to detect, investigate, prevent, or take other action regarding an actual or suspected illegal or fraudulent activities or potential threats to the rights, property, or personal safety or well-being of any person.
  5. As Required by Law: We may disclose Collected Information about you if we become subject to a subpoena or court order, or if we are otherwise legally required to disclose information. We may also use and disclose information about you to establish or exercise our legal rights, to enforce the Terms of Use, to assert and defend against legal claims.
  6. With Your Consent:  We may request your permission to share your PI for a specific purpose not described above. In such case, we will notify you and request consent before you provide the PI or before the PI you have already provided is shared for such purpose.

VII. What Choices Do You Have?

When corresponding with Elizabethtown Gas Company or our representatives, or when making a request for information or otherwise interacting with Elizabethtown Gas Company or others through the Site, you choose what information to supply, what questions to pose and comments to make, whether you wish to receive further information and by what method of communication such information should be delivered. Please take care to share only such information as is needed or that you believe is appropriate.

  1. Opting Out of Advertising Email. If we send you an email advertisement, it will include instructions on how to opt out of receiving such emails in the future. You have a choice as to whether you would like to receive advertisements and/or newsletters and company information. Terminating advertising emails will not automatically stop you from receiving certain other account emails (i.e., notifications regarding your Elizabethtown Gas Company billing statement will still be sent to you via email).
  2. Opting Out of Account Email. If you are a customer and you elect not to receive any email from us, you will have to opt-out of future emails by logging into your Elizabethtown Gas account at https://myaccount.elizabethtowngas.com/.  Once logged into your account, proceed to “Notifications” under the Profile Tab. You will be able to select and/or de-select the type of email you would like to receive from Elizabethtown Gas Company.
  3. Cookies and Other Tracking Technologies: “Cookies” are small text files that are stored within your computer’s or mobile device’s memory by a website through your browser. Cookies enable a website such as ours to keep track of your activities on that website, and to improve your use of the website, such as by keeping track of your preferences. If you reject cookies, you may still use our Site, but you may not have access to some of our Site’s functions and your ability to use some areas of our Site may be limited. IX. Elizabethtown Gas Company IX. Social Media Policy

Elizabethtown Gas Company values healthy communication with its customers, potential customers and Site users. As such, we routinely monitor and analyze Site traffic and usage patterns in order to improve our content delivery, online media, materials, opportunities and services that we describe or make available on the Site. The Sites are tools for us to foster and promote and encourage dialogue with our customers, potential customers and users and to invite the same from them. We desire for our Sites to be safe forums for discussion and we explicitly reserve the right to delete any content which we believe, in our sole discretion, is objectionable including derogatory racial, ethnic, sexual, sexist, religious, profane, pornographic and/or discriminatory slurs; advertisements and marketing materials and spam; personally sensitive information (i.e., telephone numbers, personal addresses, etc.); or any other content that Elizabethtown Gas Company in its sole discretion believes to be objectionable, offensive or inappropriate.

From time to time, we may change our Privacy Policy and post those changes on this Site. Any and all changes to the Privacy Policy shall become effective when posted on this Site.

X. Not for Children

Elizabethtown Gas Company websites are intended to be used by adults only. If some aspects of our Site provide information in a visual or audio format that appears as if it is intended for children (i.e., as in an animated informational video), please know that it is not intended for children or any persons under the age of 18. We do not knowingly or intentionally solicit, market to, or collect personal or identifying information from children under the age of 13. We strongly advise against children using our websites or giving out any personal information without their parent's or guardian's consent. If you are under the age of 18, please use our Site only with the involvement of a parent or guardian.

XI. Consent

By using this Elizabethtown Gas Company website or mobile application, you consent to this Privacy Policy. Except in certain circumstances explained in this Privacy Policy, we will not share your PII with outside parties without your consent.

XII. Changes to Our Privacy Policy
